Additional Information for your Consideration

While we support the passage of LB906 through committee, it will need a few amendments in order to have a confident position of support beyond the committee stage.
We would like to see the following amendments introduced to LB906:
AMENDMENTS Request:
(4) An employer may require an employee granted an exemption under this section to:
(a) Be periodically tested, at the employer’s expense, for infection or illness; and
(b) Wear or use personal protective equipment provided by the employer.
(c) Employer provided requirements must be FDA-approved for the intended purpose and OSHA compliant for infectious disease exposure protocol.
(5) To claim the exemption provided for in this section, an employee shall fill out and sign the vaccine exemption form and submit such form to the employer.
4(ci) Legislature will determine penalties for employer refusal of exemption
(ii) An employee may file suit for undue punishment, discriminatory policy, or termination due to submittion of a vaccine exemption
(ci) Vaccine exemption form means the form created by the department under subsection (2) of this section.
(ii) Vaccine exemption form means a notarized personal statement.
We believe these amendments would ensure that the measures required by employers would be the safest and with the most strict requirements of products that can be provided.
