Before we dive into the two Branding related bills set for public hearing on Tuesday, we want to be upfront – we are not experts. Our review of these bills will be through a lense of smaller more efficient government. For that reason we are taking a neutral position as a group. Many of our members and followers have strong feelings about the Branding Committee and the services provided therein. Any changes in this area is going to be painful for some – whether it’s an increase in fees or a complete restructure of the program – either way, some form of change is coming.

Description: Change certain fees and surcharges under the Livestock Brand Act
Statement of Intent: *LB 1187 increases the statutory cap on the per head inspection fee collected under the Livestock Brand Act from the current $1.10 to $1.50. The bill also removes the mileage charge component of the inspection fee and reverts back to previous law that authorized the Brand Committee to collect a uniform travel surcharge of no greater than $30 per stop.*

Generally, NAGO is opposed to any and all increases in fees, and we expect most of our members and followers are as well. From the information gathered/shared with us, if the same program is to be kept intact – fees will have to go up in order to maintain solvency of the program. Description: Rename the Livestock Brand Act as the Livestock Protection Act, eliminate the Nebraska Brand Committee, and change, provide, and eliminate provisions relating to livestock branding and livestock protection
Statement of Intent: *The Livestock Protection Act (“the Act”) establishes a uniform, statewide brand registration, inspection, and investigative entity for Nebraska’s cattle industry within the Nebraska Department of Agriculture.
To ensure brand inspection remains available and fiscally stable, the Act eliminates the Nebraska Brand Committee and transfers its powers to a newly established Division of Brand Registration, Brand Inspection, and Livestock Theft Investigation within the Nebraska Department of Agriculture. It will be cash-funded by inspection fees and brand registration and renewal fees.
To achieve competitive uniformity, the Act eliminates brand inspection areas dividing Nebraska’s producers and removes mandatory brand inspection requirements to create a statewide voluntary, fee-based inspection system that operates upon request.
To ensure a seamless transition, the Livestock Protection Act takes effect on January 1, 2027. This modernization effort strengthens and protects Nebraska’s rich branding and inspection tradition.*

LB1258 has caused quite the commotion. Senator Storer has taken a strong position against this bill. Senator Hansen has maintained that this bill reduces government overreach and gives statewide coverage for those who want it.
As we read through the bill, there are several key parts that we took notice of that conflict with what we have seen circulating online.
1. The branding committee is eliminated as is, but restored in a smaller (supposedly more efficient) capacity through the AG department
2. Branding remains the main method to prevent the theft of livestock
3. It does make participation voluntary, some ranchers or feedlots may choose not to brand or have inspections done
4. Our BIGGEST recommendation to this bill is the suggestion that IF there is a brand present on livestock, that the registration SHALL be checked to ensure whoever is in possession of the Livestock be confirmed as the rightful owner – the rest of the bill works seamlessly from there. Those who want the insurance pay for it. If someone is caught with a branded animal that doesnt belong to them, penalties should be doled out.

This is a silly bill. Any board of Education may already include student voices on their board if they so wish and students may participate in public comment just the same as anyone else. Many school boards already have student representation (i.e Beatrice).
We dont need a law to force school boards to bring in student representation – leave it to local control.
We’d also be remiss if we didnt point out that McKinney is likely pushing this legislation on behalf of Civic Nebraska who would work extra hard to push for their liberally indoctrinated student members to be on these boards.

Our position on the legislation is not to say we support M. Cavanaugh. We would actually push further than her bill and suggest that so long as kids are required by statute to attend public school that ALL kids should be fed by the school and that of all the wasteful spending that occurs in Nebraska school districts, that feeding kids breakfast/lunch should be one area that everyone accepts their tax dollars be utilized.

Another silly bill fueled by the liberal agenda to demonize law enforcement, and specifically immigration laws, in Nebraska. School employees are mandatory reporters – if they are aware of a law being broken they have an obligation to make the proper authorites aware of it. Why is Dungan trying to make criminals out of school employees for following the law?
Furthermore, this feeds into the narrative that ICE is conducting their job through nefarious and underhanded means, which has been proven false time and time again. If ICE is present, we can expect they have valid reasons and proper procedure has been followed.

There are only 180 instructional days for an entire school year. So they should be allowed to miss 10% of their scheduled work days? Most people would get fired if they tried to call in sick 10% of the time. So it’s basically one day off every 2 weeks. Nobody is sick that much.

TIF has been a vastly detrimental to many of the largest cities in Nebraska. As cities utilize TIF, the taxation becomes more burdensome on the residents of that area. It should also be noted that TIF has become widely abused and coincidentally those who receive TIF funding also tend to be donors to the very elected officials voting in favor of it.
Debt is always bad and should not be made easier for our government to allow.

While many people will support this for the more recent occurrence with the Medical Marijuana initiative, we look even further back at initiatives like the Voter ID initiative that was passed and then vastly changed from the original Intent. It would make sense that if the legislature believes their interpretation to be a better approach of an initiative that it go back to We the People to confirm or deny.

This proposal is unnecessary. The argument will be made that this process would ensure some level of bipartisanship or even nonpartisanship – but the reality is, there’s no such thing. Statement of Intent: *LB 969 is designed to enhance transparency and public accountability in the financial operations of Nebraska’s political subdivisions by requiring the Auditor of Public Accounts to create, maintain, and publicly host a comprehensive online database containing detailed financial information for all counties and municipalities statewide. The database will compile key data—including revenue sources, expenditures, and full balance sheets detailing assets and liabilities—drawn from the most recent audit reports already filed with the Auditor. It will be made accessible for public inspection on the Auditor’s website, with an implementation date no later than January 1, 2027.
Counties, along with cities of the metropolitan class (such as Omaha), primary class (such as Lincoln), first class, second class, and villages, will be required to submit the necessary information to the Auditor annually for ongoing updates, with the database refreshed within thirty days of receipt. These entities must also provide historical financial data back to calendar year 2016 where available, to be incorporated as soon as practicable. The legislation explicitly protects confidential information or records exempt from disclosure under state or federal law, ensuring compliance with existing public records statutes while promoting greater visibility into local government finances for taxpayers, researchers, and oversight entities.*

Description: Require the Auditor of Public Accounts to investigate impoundment of funds by the Governor and submit a quarterly report
Statement of Intent: *LB 1147 requires the Auditor of Public Accounts to investigate any impoundment of state funds in which the Governor withholds or delays funds appropriated by the Legislature. The bill directs the Auditor to submit a quarterly report to the Clerk of the Legislature that includes: a list of impounded funds; the date the funds were impounded; the length of time the funds were impounded; the reason or explanation for the impoundment; and the estimated fiscal, economic, or budgetary impact of the impoundment. The report may also include any other information the Auditor deems pertinent.
A complaint alleging the impoundment of funds may be filed with the Auditor by any member of the Legislature, a state agency, or an eligible recipient of public funds approved by the Legislature.
LB 1147 contains an emergency clause and would take effect immediately upon passage and approved.*

This proposal seems to be a redundancy of the current responsibilities of the Public Auditor. This position is already responsible for ensuring the public funds are used appropriately and within the confines of state statute. What this would do is make it easier for democrat senators to harass the republican governor anytime he makes a budgetary decision they disagree with – it wreaks of the potential for abuse.

This seems like a slippery slope. While we dont deny there are people who file frivolous lawsuits against political subdivisions and public officials – there are many instances where they are not. Yet, even in those cases if an attorney or public official is well enough connected they would make that claim and stick the Nebraskan with the bill.
It’s also worth mentioning that just last session a somewhat inverted bill of this nature, introduced by fmr. Senator Dan McKeon, in which if a Nebraskan was targeted by the government they could receive attorney’s fees or compensation was strongly opposed by the Introducer of this bill.
If we’re going to advocate for compensation for the government, then that should be equally applied to Nebraskans.

Nothing in this bill adds or changes the qualifications for office established in the Constitution of Nebraska.*

Mountain lions at times create an imminent threat to Nebraskans, their livestock, pets, and even small children. Currently, however, unless you/your dependent/etc are under direct and immediate attack by a mountain lion you CANNOT protect yourself from the predatory animal. If you do attempt to protect yourself, even rightfully so, you will have to undergo a very thorough and costly investigation to prove you had no other choice in the situation.
By adding permits in the case of mountain lions, Nebraska would be taking a step in the right direction, especially in rural communities, to ensure protection rights as outlined in the Nebraska Constitution article 1 section 1.

This bill proposal was majorly opposed by our members and followers when first introduced. NAGO will simply reiterate that social/welfare programs should be reserved for citizens of this country. We already welcome, with open arms, our country to those who are seeking a better life – these refugees and immigrants should work for the American Dream just the same as the rest of the US citizenry and when/if they become citizens they can the reap the many benefits of our societies social programs.

Statement of Intent: *LB978 would create a civil cause of action allowing individuals depicted in or exposed to obscene material, child sexual abuse material, or content promoting child sexual exploitation to seek damages against entities that intentionally distribute such content on publicly available Internet websites. The bill would authorize the Attorney General to bring civil actions to restrain violations and would provide that Internet utilities are not liable solely for providing access or connection services. Additionally, LB978 would prohibit the sale or distribution of child sexual exploitation devices or images and establish civil penalties of up to ten thousand dollars per violation, enforceable by the Attorney General or county attorneys.*

Yet another bill from McKinney that aims to demonize our law enforcement. At a time when recruitment is already at an all time low – this proposal would create further hurdles. Law enforcement deserves our support – so long as you are a law abiding individual, there should be no concern for the existence/presence of LEOs.

This proposal brings Nebraska into alignment with the EO from President Trump on no tax on tips or overtime. In order for Nebraska to implement these changes a statutory change may be required. It certainly doesnt hurt to put it on the books.
