Statement of Intent: *LB 719 clarifies that infrastructure development costs essential to the success of an industrial rail access business park may include certain off-site improvements on property not owned by the applicant when those improvements directly benefit the project. The intent is to ensure critical access, rail, and utility infrastructure necessary for business park development is clearly eligible under the Nebraska Rural Projects Act.*

More Information:
There are two major concerns with LB719.
1. How does this implicate an approved budget or TIF awarded? If a project is underway and it is then determined additional updates are needed, it would not be unreasonable to presume that costs too will be increased. Could this, therefore lead to a potential need to increase local taxes?

2. The verbiage allowing an applicant to proceed with updates/construction on property not owned by the applicant presents serious concern of property rights, especially in residential/commercial areas near such projects.

Statement of Intent: *LB748 would conform Nebraska to the federal changes regarding “529 Plans” under the College Savings Plan Program that became a part of the One Big Beautiful Bill signed on July 4, 2025,

LB748 expands the types of elementary or secondary school expenses beyond tuition (e.g. to include books, tutoring, online material), up to $20,000 per year, consistent with federal changes. LB748 also provides that College Savings Plan Program funds may be used for postsecondary credentialing expenses, consistent with federal changes.*

More Information:
LB748 will be strongly opposed by the NSEA and anti-school choice advocates. If you wish to see this bill move forward, it will be imperative that you submit supporting online comments or attend the in person public hearing.

It is important to remember that these are private, personal dollars. Any insinuation that this is somehow taking from public schools by hiding taxable dollars in a 529 Plan is ignoring the many other types of accounts and plans that also avoid taxation and can build on interest. This is not about being anti-public school.

Statement of Intent: *LB924 would update the learning community statutes to clarify that the elementary learning center levy can be used for purchasing or leasing of facilities and that 10 percent of that levy shall be the maximum used for administrative staff of the learning community. The bill also adds an allowable duty to partner with entities with a goal of increasing graduation rates.*

More Information:
This bill creates an important distinction on compensation and caps the income of administration at 10% of the levy needed to buy or lease a building.
We do have some concern of the vague “The bill also adds an allowable duty to partner with entities with a goal of increasing graduation rates.” Many vendors may offer partnerships with the stated intention of increasing graduation rates, while they may or may not have that result, any partnership is likely to incur additional costs that will affect the taxpayers of the district.

This bill is currently sitting as a white copy, essentially a placeholder, however, according to the original text of the bill, LB940 removes Blue No. 1, Blue No. 2, Green No. 3, Red No. 40, Yellow No. 5, and Yellow No. 6
This could serve as a pivotal change in the foods served to Nebraska Children and lead to a direct positive change in their dietary choices, behavior in school and in general, and health in general.
It is widely known and supported by medical research that artificial food dyes negatively impact the neurological and physical health of children and adults.

Description: Change and eliminate provisions of the Environmental Safety Act

Statement of Intent: *LB760 proposes amendments to the Environmental Safety Act, Neb. Rev. Stat. § 81-15,261 to 81-15,292, and would transfer certain regulatory authorities related to swimming pools recreation camps, and mobile home parks from the Department to local governments (county, city, or village) that have jurisdiction over such facilities. The bill would eliminate the Environmental Safety Cash Fund, as the Department of Water, Energy, and Environment would no longer collect revenues from issuing or renewing licenses and permits, nor conduct annual inspections of such facilities under this proposal. The local government with jurisdiction over a given facility may adopt minimum sanitary ang safety requirements through local regulations or ordinances, may perform annual inspections, may issue annual operating permits, and continue to exercise their existing nuisance abatement and enforcement authorities
The bill would eliminate the requirement for Department staff to conduct evaluations of domestic water supplies and onsite wastewater treatment systems that are currently conducted upon request by individuals as a requirement for certain loans.*

More Information:
This seems to be a logical move to eliminate oversight at the state level and appropriately give it over to the local level.

This might increase costs at the local level based upon the levels of oversight implemented by the governing body at the local level.
It should also decrease the costs at the state level by eliminating required evaluations/reports/etc.

Description: Create a fund and change provisions relating to water well fees, use of funds, and powers and duties of the Department of Water, Energy, and Environment

Statement of Intent: *LB761 would implement fees related to four Department of Water, Energy, and Environment programs including well registrations, livestock facility permitting, hazardous waste generation under Resource Conservation and Recovery Act (RCRA), and permitting activities under the National Pollutant Discharge Elimination System (NPDES). Sec. 2 of the bill would amend Section 46-606 to increase well registration fees from $40 to $200. Sec. 3 of the bill would adjust the fee structure to ensure that livestock facility permitting fees are adequate to meet forty percent of program costs instead of twenty percent. Sec. 1 and 4 of the bill would give the Department the authorities to establish rules to assess fees from hazardous waste generators, allowing for a fee structure, whether flat or annual based on the weight or volume of hazardous waste generated through the rulemaking process.

Additionally, the bill would redirect fees currently collected by the Department from facilities that process or dispose of hazardous waste so that those revenues are retained by the Department in the Integrated Solid Waste Management Cash Fund rather than the General Fund. Sec. 5 of the bill would give the Department the authority to establish rules to assess fees for administering federal Clean Water Act programs including the NPDES, industrial pretreatment, water planning, 319 non-point source, and surface water monitoring.*

LB951 is eliminates a huge concern about taxation without representation. Nebraskans currently living in the, typically 3 miles outside the city or village, immediate zone outside of their city or village would be able to vote in city/Village Board races.

The only question that arises from this legislation, is whether LB951 also makes it allowable for those Nebraskans to actually run for a seat on the board.
