The NCHEA has worked with Senator Robert Clements’ office, District 2, and consulted with HSLDA’s Kevin Boden to generate LB1027. Senator Clements submitted LB1027 into the Nebraska Legislature for consideration this session.

LB1027 would streamline the homeschool statute requirements for parents and the Nebraska Department of Education.
LB1027 would:
1) Remove the existing options for government officials to conduct school visitations and achievement testing of exempt school (homeschool) students,
2) Eliminate the requirement to provide information necessary to prove [via ‘evidence’] that the requirements of 79-1601 will be satisfied and replace this with assurance that the homeschool will do such by signing your intent to do so.
3) Remove the necessity of providing information to demonstrate that individuals monitoring (i.e., teaching) students have “have demonstrated an alternative competency to monitor instruction or supervise students …”. This is appropriate in view of LB705 (2023), which removes basic skills competency testing requirements for the teaching profession in approved or accredited schools.
4) Replaces the existing requirement to annually submit an exemption filing to the Commissioner of education to only when students change, and
5) Removes the requirement for both parents to sign an exemption filing. By requiring only one parent to sign the exemption forms, LB1027 would change the dynamic by placing the burden on the parent not wanting home education, often showing little/no physical or emotion involvement with their child, to responsibly file a petition in court to challenge the homeschool-minded parent. As it is now, there is little/nothing that a joint-custody homeschool-minded parents can do because the law clearly requires two parents.
